A majority of Supreme Court justices didn't seem convinced Monday that federal regulators misled companies as they refused to allow them to sell sweet flavored vaping products following a surge in teen e-cigarette use.

The Supreme Court on Monday pressed the Food and Drug Administration on whether it followed the law in its effort to keep flavored e-cigarettes off shelves, weighing a lawsuit from a multibillion-dollar industry that has come under scrutiny because its products are popular with school-aged children.

The high court heard a case Monday on the FDA’s refusal to let two e-cigarette companies sell flavored vape products due to their health risk to youths. Henigan supports the FDA’s position. “The flavors attract kids to them. And then the nicotine in these products keeps them addicted,” he said.
